I disagree with the following:

Q2 - False, admission of a state is decided by a two thirds majority which is not a simple vote as it also has to be determined whether the state has complied with the substantive requirements in article 4(1). See Pg 58 of textbook.

Q12 - True, refer to page 204.

Where did you find the answer for Q5?

Question 5

Article 4 deals with membership. So I downloaded the charter:

Article 4
1. Membership in the United Nations is open
to all other peace-loving states which accept the
obligations contained in the present Charter and,
in the judgment of the Organization, are able and
willing to carry out these obligations.
2. The admission of any such state to membership
in the United Nations will be effected by a
decision of the General Assembly upon the recommendation
of the Security Council.

Am I right if I say that for the entire topic 1 in the study guide, we only have to study Dugard chapter 1 which is only 15 pages???

Hey Amy, please be advised that you should be following the LCP4801_102_3_2018 Study guide - you will notice the prescribed textbook is no longer Dugard but Strydom.

See p 21 of study guide (From a procedural point of view, the applicant state must have been recommended for membership by the Security Council (nine out of fifteen affirmative votes are required), after which the General Assembly decides on admission, which requires a two-thirds majority of those members who are present and voting.)

12 is true. See 5.4.3 in prescribed book.

13 is false. A state has jurisdiction over crimes committed, not acts committed.

14 is true. See 6.4.6 in prescribed book.

The question states

"If a state is recommended for UN membership by the Security Council, the General Assembly must decide on admission of that state by a simple majority of the voting members."

As per page 21:

Applicant state must have been recommended for membership by the Security Council (nine out of fifteen affirmative votes are required), after which the General Assembly decides on admission, which requires a two-thirds majority of those members who are present and voting.

Therefore

If a state is recommended for UN membership by the Security Council, its must then have had nine out of fifteen affirmative votes are required.

Thereafter
General Assembly decides on admission, which requires a two-thirds majority (majority of the voting members) of those members who are present and voting.

As a result, should this answer not be true. As it has passed the Security Council vote and is to the GA for voting, which simply requires the majority vote?

I think we need to make a distinction between recommendation and admission.

according to me, recommendation is done by Security Council which requires 9 out of 15 affirmative votes

admission is done by the General Assembly which requires a two-thirds majority (majority of the voting members)


As per page 21:

Applicant state must have been recommended for membership by the Security Council (nine out of fifteen affirmative votes are required), after which the General Assembly decides on admission, which requires a two-thirds majority of those members who are present and voting.

The key term for me is after which which means after the recommendation by Security Council which requires 9 out 15 Affirmative votes.
